Chapter 1. General Provisions

Article 1 (Purpose)

These Terms of Service (hereinafter "Terms") govern the rights, obligations, and responsibilities between The Nines (hereinafter "Company") and its members in connection with the use of the influencer marketing platform X30 (hereinafter "Service").

Article 2 (Definitions)

The definitions of terms used in these Terms are as follows:

  1. "Service" refers to the influencer-business owner campaign matching and related ancillary services provided by the Company through the X30 platform.
  2. "Member" refers to any individual who has agreed to these Terms, registered for the Service, and holds an account.
  3. "Business Owner" refers to an individual or entity that registers campaigns and recruits influencers through the Service.
  4. "Campaign" refers to a promotional collaboration listing registered by a Business Owner on the Service, which includes specific missions such as in-person visits, content creation, and the like.
  5. "Content" refers to all creative works, including photographs, videos, and text, produced by a Member in the course of performing a Campaign.

Article 3 (Effectiveness and Amendment of Terms)

These Terms become effective upon being posted on the Service or otherwise communicated to Members. The Company may amend these Terms to the extent permitted by applicable laws and regulations, and shall provide notice within the Service at least seven (7) days prior to the effective date of any such amendment. If a Member does not express objection by the effective date of the amended Terms, the Member shall be deemed to have consented to such amendments.

Chapter 2. Account

Article 4 (Eligibility)

  1. You must be at least fourteen (14) years of age to register for the Service. Minors aged 14 to 17 must obtain consent from a parent or legal guardian before applying for any Campaign.
  2. If the Company discovers that a user under the age of 14 has registered, the Company may immediately delete the account in question.

Article 5 (Registration and Authentication)

  1. Registration is completed through Google OAuth authentication.
  2. Members must provide accurate and up-to-date information at the time of registration. Provision of false information may result in restricted use of the Service.
  3. The Company reserves the right to decline or subsequently revoke any registration application.

Article 6 (Account Management)

  1. Each individual may create only one (1) account. If multiple accounts are detected, all such accounts may be suspended.
  2. Members are responsible for safeguarding their account credentials and may not transfer or share their account with any third party.
  3. Members must promptly notify the Company if unauthorized use of their account is suspected.
  4. Members may request account deletion within the Service. A seven (7) day cooling-off period is provided after the request, during which the Member may withdraw the request and restore the account.
  5. After the cooling-off period expires, the Company will retain the Member's information in an inactive state for six (6) months for the purposes of dispute resolution and fraud prevention. The information will not be actively used during this retention period.
  6. After the six (6) month retention period, all personal information and activity records will be permanently deleted, except for data that must be retained under applicable law. Deleted data cannot be recovered.

Chapter 3. Service Usage

Article 7 (Scope of Service)

The Service provided by the Company includes the following:

  1. Campaign browsing and application
  2. Campaign selection result notifications
  3. Content submission and mission management
  4. Other ancillary services as determined by the Company

Article 8 (Service Fees)

The Service is provided free of charge to Members. However, the Company may introduce paid services in the future, in which case the terms and conditions of such paid services will be announced in advance.

Article 9 (Modification and Suspension of Service)

  1. The Company may modify or suspend all or part of the Service for operational or technical reasons.
  2. The Company will provide advance notice of any modification or suspension. However, in unavoidable circumstances, notice may be given after the fact.
  3. The Company shall not be liable for any damages arising from modifications or suspensions of the Service.

Chapter 4. Campaign Participation

Article 10 (Campaign Application)

  1. Members may freely apply for Campaigns listed on the Service.
  2. Information submitted at the time of application (e.g., follower count, interests, self-introduction) must be accurate. Submission of false information may result in penalties.

Article 11 (Selection and Participation)

  1. Selection of Campaign participants is at the discretion of the Business Owner or the Company. Submission of an application does not guarantee selection.
  2. Selected Members must faithfully perform the missions specified in the Campaign (e.g., visits, content creation, posting).
  3. Selected members must submit content within 7 days of the visit date.
  4. Failure to submit within the deadline will result in an overdue status. Continued non-compliance may lead to restrictions on future campaign applications.
  5. Cancelling participation without a valid reason after being selected may also result in the same restrictions.

Article 12 (Penalties for Non-Performance)

The Company may restrict a Member's use of the Service in any of the following circumstances:

  1. Failure to perform the mission after selection
  2. Submission of Content that significantly deviates from the Campaign requirements
  3. Unauthorized breach of commitments made to the Business Owner (e.g., scheduled visit times)
  4. Repeated cancellations after selection

Chapter 5. Content and Intellectual Property

Article 13 (Content Ownership)

  1. Copyright in Content created by a Member in the course of performing a Campaign shall belong to that Member.
  2. However, by participating in a Campaign, the Member agrees to grant the Business Owner a license to use such Content for promotional purposes (including reposting, editing, and advertising). The specific scope of use shall be governed by the terms of each Campaign.
  3. The Company may use such Content for service promotion, portfolio, and marketing purposes for one (1) year following the conclusion of the Campaign. After such period, the Content will not be used without the Member's separate consent.

Article 14 (Brand Usage)

Members may use the Business Owner's trade name, logo, and brand name within the scope of the Campaign. After the Campaign concludes, Members may not use such branding for commercial purposes without the Business Owner's separate consent.

Article 15 (Right of Publicity)

Where a Member includes their own likeness in Campaign Content, the Member consents to such Content being utilized by the Business Owner in accordance with the Campaign terms. Where the likeness of a third party is included, the Member is responsible for obtaining that third party's consent.

Chapter 6. Privacy

Article 16 (Protection of Personal Information)

  1. The Company protects Members' personal information in accordance with the Personal Information Protection Act and other applicable laws of the Republic of Korea.
  2. The collection, use, provision, and management of personal information are governed by the Company's Privacy Policy.
  3. The Company may provide Member profile information to Business Owners for Campaign matching purposes. When applying for a Campaign, the Member's name, email address, Instagram handle, phone number, and application notes are shared with the Business Owner, subject to separate consent obtained at the time of application.

Chapter 7. Prohibited Conduct

Article 17 (Prohibited Acts)

Members shall not engage in any of the following acts while using the Service:

  1. Registering false information (e.g., follower count, area of activity, experience) or misappropriating another person's information
  2. Using another person's identity or account to register for the Service or apply for Campaigns
  3. Submitting duplicate applications for the same Campaign using multiple accounts
  4. Receiving Campaign benefits without performing the required mission
  5. Interfering with the normal operation of the Service or gaining unauthorized access to systems
  6. Using automated tools (bots, scripts, etc.) to access or use the Service
  7. Defaming or infringing upon the rights of the Company, Business Owners, or other Members
  8. Any other act that violates applicable laws or these Terms

Chapter 8. Service Restrictions and Account Suspension

Article 18 (Restriction of Service Use)

  1. If a Member violates these Terms or engages in prohibited conduct, the Company may, after prior notice, take any of the following measures:
    • Restriction of Campaign applications (for a specified period)
    • Suspension of Service use (for a specified period)
    • Permanent suspension and deletion of the account
  2. In urgent circumstances (e.g., system abuse, violation of law), the Company may take immediate action without prior notice.

Article 19 (Appeals)

  1. A Member who objects to a service restriction may file an appeal within fourteen (14) days of the measure by emailing master@thenines.me.
  2. The Company will notify the Member of the review results within seven (7) business days of receiving the appeal.
  3. If the appeal is found to have merit, the Company will immediately lift the restriction.

Chapter 9. Disclaimer and Liability

Article 20 (Disclaimer)

  1. The Service is provided on an "as-is" basis. The Company does not warrant the completeness, accuracy, or reliability of the Service.
  2. The Company shall not be liable for any interruption of the Service caused by force majeure, including natural disasters, system failures, or other circumstances beyond reasonable control.
  3. The Company is not obligated to intervene in disputes between Business Owners and Members (e.g., non-performance of Campaign terms, discrepancies in provided benefits) and shall not be liable for damages arising therefrom. However, the Company may provide mediation assistance to facilitate resolution.
  4. The Company shall not be liable for any decisions made by Members based on information obtained through the Service.

Article 21 (Limitation of Liability)

  1. Where a Member suffers damages due to the Company's fault, the Company shall be liable only for ordinary and direct damages.
  2. The Company's liability shall be limited to the amount paid by the Member in connection with the Service. For Members using the Service free of charge, the Company shall be liable only in cases of willful misconduct or gross negligence.
  3. Where the Company or a third party suffers damages due to a Member's fault (e.g., submission of false information, violation of these Terms), the Member shall be liable for such damages.

Chapter 10. Miscellaneous

Article 22 (Governing Law)

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.

Article 23 (Jurisdiction)

Any dispute arising out of or in connection with the Service shall be submitted to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's principal office.

Article 24 (Notice of Amendments)

  1. When the Company amends these Terms, it shall specify the details of the amendments and the effective date, and provide notice via the Service or email at least seven (7) days prior to the effective date.
  2. For amendments that materially affect the rights or obligations of Members, notice shall be provided at least thirty (30) days prior to the effective date.
  3. Continued use of the Service after the effective date of the amended Terms shall constitute acceptance of such amendments.

Article 25 (General)

  1. Matters not addressed in these Terms shall be governed by applicable laws and customary commercial practices.
  2. If any provision of these Terms is held to be invalid, the remaining provisions shall continue in full force and effect.

Supplementary Provisions

These Terms shall be effective as of March 17, 2026. (Revised: March 17, 2026)
